Privacy Policy

The Bromhead Medical Charity takes its responsibility regarding beneficiary information very seriously. When you apply for support from the Bromhead Medical Charity, we ask you for a range of personal in-formation. This statement tells you why we need that information, how we use or process it, who we share it with, how we safeguard it and what rights you have to request to see it.

Why we hold personal information about you.

Essentially, we only hold personal information for those people who ask us to support them. We hold the information in our capacity as the data controller for the administration of the charity and specifically to administer any support we offer you.

The legal basis for our use of your personal data will generally be that we need to process your personal data in order to :

a. Satisfy our legal obligations as a charity

b. Meet the legitimate interests of providing healthcare support to you to perform our obligations and exercise any right and discretions the trustees have in respect of the support we offer to individual beneficiaries and/or

c. Process your data to determine eligibility against our criteria for support or to take steps, as agreed with you, to arrange diagnosis, treatment, therapy or care which we have agreed to fund (up to our defined financial limits).

What personal information we hold.

The personal information which you provide on our application form includes :

a. Contact details, including name, address, telephone number and email address

b. Identifying details including, date of birth, NHS number

c. Financial Information relevant to us establishing that you meet the charity's criteria for

support. Once your financial criteria has been assessed your financial information is shredded,

not held on file.

d. Information about you and your family, dependents or personal circumstances, for example,

details of your medical history and/or current diagnosis.

All of the above information we will obtain from you in our application form or in discussion with our Nurse Advisors during an assessment.

We may also obtain information from healthcare providers whilst you are receiving support from us, this may include:

a. Details of any diagnostics, treatment, therapy or care given as part of our support to you

b. Information to and from healthcare practitioners regarding your health, this could include

information to or from your GP, Consultant, Therapist and other healthcare providers.

How we will use your personal data.

We only use your personal data to administer the healthcare support we offer you.

This will include the processing of your personal data for any or all of the following reasons:

a. To contact you

b. To assess eligibility for support from the charity

c. For statistical and financial control, monitoring and reference purposes

d. To address queries from you and healthcare providers regarding the services provided to you

Organisations with whom we may share your personal data.

In order to provide you with the healthcare support you need we have to work with others. This means that we may have to share relevant personal information with other organisations and

people including:

a. The charity's auditors – Streets & Co, Tower House, Lucy Tower Street, Lincoln.

b. The charity's Legal Advisors and our Insurance Company

c. Healthcare Providers including your GP, NHS and Independent Hospitals, therapists and other

healthcare practitioners from whom you receive any healthcare intervention. It may also

include the Clinical Commissioning Group and other parts of NHS England.

However, we will never share your personal financial data with any other healthcare provider.

In each case we only share the information which is reasonably required for the purpose of

assessing your application.

The organisations referred to above may use the data to perform their functions in relation to the support the charity gives as well as for statistical and financial modelling (such as calculating their costs and for quality assurance), business administration and regulatory purposes. They may pass data to other third parties (for example, Hospitals may pass data to Clinical Commissioning Groups for the purpose of indi-cating levels of activity), to the extent they consider the information is

reasonably required for a legitimate purpose.

Where requested, if we consider that it is reasonably required, we may also provide your data to gov-ernment and law enforcement organisations - including Lincolnshire County Council (for

example, if a safeguarding concern arose), Care Quality Commission (for example, if there were concerns about a healthcare provider from whom you had received treatment with our support). They may then use the data to carry out their legal functions.

In some circumstances the recipients may be outside the UK. This means that your personal data may be sent outside of the EEA to a jurisdiction which may not offer the level of protection as is required by EEA countries. If this occurs, we are obliged to verify that appropriate safeguards are in place with a view to safeguarding your data.

We do not carry out any automated processing for marketing purposes using your personal data and will not share this data with anyone for the purpose of marketing to you.

How long we keep your personal data.

We only keep your personal data for as long as necessary to fulfil the purpose for which it was

collected and for so long afterwards as we consider we may be required to deal with any questions or complaints that we may receive, and to meet our legal and regulatory obligations. We will

ordinarily keep your personal data for 6 years from the completion of our support, except that in respect of any child supported by us, we will retain their information until 6 years after their 18th birthday.

Your rights.

You have a right to access and obtain a copy of the personal data that the charity holds about you, and to ask for that data to be corrected if there are any errors or if it is out of date. In some

circumstances you may have the right to ask the charity to restrict the processing of your personal data, to object to processing or to transfer or erase your personal data. You can obtain further

If you wish to exercise any of these rights or have any queries or concerns regarding the

processing of your personal data, please contact us using the details given below. You also have the right to lodge a complaint in relation to this privacy notice or the Charity’s processing

activities with the Information Commissioners Office which you can do through the website above or their telephone helpline.

The personal data we hold about you is used to determine your eligibility for support and then, provide you with the healthcare support we have agreed to give. If you do not provide such

information or ask that the data we hold is deleted or restricted, this may affect our ability to

assess and support your healthcare needs. In some cases it could mean that the Charity would be una-ble to support you further.
